Unless otherwise stated, these Terms & Conditions, including this Privacy Policy, (together “Terms & Conditions”) apply only to https://dtlab-labcn.org/en/.

By using and visiting the https://dtlab-labcn.org/en/ website, you (or the “user”) accept these Terms & Conditions.


About us

The Digital Trust Laboratory of Canada (“DTLab”) is a Canadian federal non-profit organization dedicated to strengthening cybersecurity by advancing safe and seamless digital credentials. DTLab believes that the best solutions will require a collaborative approach with multiple participants across the economy and is committed to facilitating just that. Its unbiased team of specialists tests and experiments with governance and technology models designed to leverage digital credentials in Canadians’ day-to-day lives. Its work supports efforts to ensure various solutions work across the country and internationally.


Use of the dtlab-labcn.org website

Principles of use:

  1. You may not divert in any way the normal use of the website for purposes contrary to law and you may not restrict or inhibit the use of this website by other users;
  2. When using the dtlab-labcn.org website, avoid any questionable, misleading or unethical practices that are or could be detrimental to DTLab or its users;
  3. You must not introduce any viruses or other items of a malicious or technologically harmful nature when using the DTLab website, or otherwise attack, or attempt to attack, this website in any way;
  4. You may not access or attempt to access the website or its servers in any unauthorized manner.

Intellectual property

DTLab holds the intellectual property rights, or holds a license to use, on the entire content of the website. You may only use it in accordance with the provisions of these Terms & Conditions. Nothing herein shall be construed as granting any right or license, except as expressly provided. You shall not use the DTLab logo without the prior written consent of DTLab.


Privacy policy for information collected on the dtlab-labcn.org website

The following terms regarding the protection of information apply to information received and collected through the DTLab website, or by means of a form or Google Docs accessible from this website.

a. Information collected

When you use one of the web forms integrated into the dtlab-labcn.org website such as our contact form and form for the submission of co-creation projects, some information about you will be collected and may include:

  • Your first and last name, email address and phone number;
  • Details regarding the subject of your request, communication or question.

When you contact us directly by email, we collect and store your email address and the information included in your communication.

b. How your information is used and shared

This information, including personal information about you, may be used for the following purposes:

  • To know the details of the request, question or project submission;
  • To contact or respond to the sender of the request or question regarding the subject of the communication;
  • Collect project submissions and contact the submitter;
  • Approach third parties regarding submissions for co-created projects in order to assess their interest in participating in the project. On this subject, see the details below concerning the confidentiality of co-creation projects.

This information, including personal information about you if included in the information you provide to DTLab, may be shared with the following persons:

  • Concerning submissions for co-created projects:
    • DTLab leadership team and any other DTLab employee involved in the project intake process;
    • DTLab Steering Committee responsible for reviewing, approving and prioritizing project proposals submitted to DTLab;
    • Third parties such as potential collaborators and funders, in order to verify whether the selected third parties would be interested in participating in or funding the project. In this respect, see the details below concerning the confidentiality of co-creation projects.
  • Concerning all other requests :
    • DTLab personnel concerned by the request or question;
    • DTLab personnel responsible for receiving and sorting incoming requests and questions.

Non-Confidentiality of Co-created Projects. The existence and description of co-created projects are considered public information by DTLab and are not subject to confidentiality provisions from the moment a submission for a co-creation project at DTLab is made. After such submission, you accept that project title, description, participant, and status information may be published by DTLab on its website and updated as needed during the life of the project. You further accept that DTLab, during the Intake process of co-created projects, may approach and share co-created project information with third parties, at DTLab’s discretion, for the purpose of verifying if selected third parties would have interest in participating in or funding the project. For greater clarity, the following provision applies to the outreach phase of the intake process of DTLab’s co-creation projects:

  • Public Google docs used for the outreach phase of co-creation projects. Please note that, in the spirit of transparency, the Google docs used in the outreach phase of the intake process of DTLab’s co-creation projects and the information it contains, including comments and suggestions, are considered public and can be consulted by anyone at any time. Please do not include any personal or confidential information in comments or suggestions. By commenting on these documents or adding suggestions, you agree: (1) that your name will be displayed and associated with any comments or suggestions you publish. The same applies to any information you have chosen to make visible according to your Google account privacy settings. Please note that it is possible to comment or make suggestions anonymously, for example, by opening the document in a private browser window, and (2) that DTLab may use your comments and suggestions with your name and share them with the original author of the submission in order to finalize the submission with them. DTLab moderates all comments and suggestions, and reserves the right to remove or delete them at any time at its sole discretion. Comments or suggestions deemed to contain foul language, intent to harm, violence, hate speech, trolling or irrelevant will be removed immediately and their author may be banned from commenting on future documents. Google has its own Privacy Policy and Terms of Service and you can refer to them for further details.

Your information may also be communicated to DTLab service providers such as DTLab consultants to whom it is necessary to communicate the information.

For data storage purposes, your personal information, when applicable, may be transmitted to our cloud service providers and may be hosted/communicated outside of the Province of Quebec.

Your information will never be shared by DTLab with other third parties or used for other purposes by DTLab.

c. Managing your information 

You may request access to your personal information held by DTLab, and request correction if it is inaccurate, by submitting a written request to the DTLab Privacy Officer at the following address: legal.compliance@dtlab-labcn.org.

In the same way, and subject to applicable legal and contractual restrictions, you may withdraw your consent to the communication or use of the information collected.

d. Restrictions

Only required information is collected by DTLab. Personal information is used or communicated only for the purposes for which it was collected, and is retained only as long as necessary for the fulfillment of those purposes, unless a minimum retention period is required by applicable law or regulation.

At the end of the retention period or when the personal information is no longer required, DTLab will ensure that it is destroyed in a secure manner.

If DTLab wants to use the information provided for any other reason or purpose, DTLab must obtain your consent again for such use.

e. Protection of personal information

DTLab also has a more detailed policy regarding the protection of privacy, which is intended to set out the expectations and operational constraints related to the protection of personal information held by DTLab. This policy applies to the directors, officers, employees, consultants and volunteers of DTLab who receive, manage and consult personal information.

Access to personal information held by DTLab is restricted and secure, and reasonable safeguards are in place to protect it. The measures we take to protect your information include the following:

  • Device protection: All devices (smartphone, tablet, laptop and desktop) on which personal information can be accessed, displayed or updated must be protected by an antivirus software approved by DTLab;
  • Our Services Agreements with our consultants contain confidentiality provisions and/or we sign non-disclosure agreements with them;
  • DTLab has a Security of Client Confidential Information Policy that applies to its employees, and a Contractor Practices Procedure that contains confidentiality provisions;
  • Access Restriction: Personal information must be kept in a manner that only authorized DTLab representatives who have a legitimate need to know, due to their position and role at DTLab, can access it. DTLab must implement this access restriction by enforcing application or network user right permissions.

However, no guarantee can be given regarding the infallibility of the measures implemented. In the event of a breach of personal information that concerns you, DTLab will endeavor to notify you promptly so that you can take appropriate action.

f. Additional information on the technologies used  

  • Use of cookies

Cookies are data files sent to the computer of a website visitor by the website during its consultation and can have several uses. The DTLab website uses such cookies.

DTLab website uses cookies, including:

    • To remember the settings and preferences of visitors, for example, for the choice of language and to allow tracking of the current session.
    • For statistical purposes to know the behaviour of visitors, the content consulted and to allow the improvement of the website.

The DTLab website may use the following types of cookies:

    • Session cookies: These are temporary cookies that are kept in memory for the duration of the website visit only.
    • Persistent cookies: These are kept on the computer until they expire and will be retrieved the next time the website is visited.

Non-essential cookies are deactivated by default, and visitors may choose whether or not to activate these functions when consulting the website. Essential cookies are necessary for the operation of the website.

It is also possible to activate and deactivate the use of cookies by changing the preferences in the settings of the browser used.

  • Web forms

We also use tools from our service providers to integrate the web forms used on our website. These forms may involve the use of cookies originating from these suppliers. These suppliers have their own policies:

Our web forms may also use Google’s reCAPTCHA tool to verify that the user is human and not a robot or malware. For more information, please consult the reCAPTCHA website and the Google Privacy Policy.

  • Use of Google Analytics

The dtlab-labcn.org website uses Google Analytics to enable its continuous improvement. Among other things, Google Analytics makes it possible to analyze how a visitor interacts with the website. Google Analytics uses cookies to generate statistical reports on the behavior of website visitors and the content consulted.

Information from Google Analytics will never be shared by DTLab with other third parties.

It is possible to install a browser add-on to disable Google Analytics.


Links to third-party websites

DTLab is not responsible in any way for external third-party websites to which the dtlab-labcn.org website may refer by means of a hyperlink or otherwise. DTLab has no control over their content or the manner in which they manage the protection of your information and interact with your computer, tablet or smartphone. You agree to hold DTLab harmless from and against any and all liability arising from your use of these third-party websites.


Limitation of warranty and disclaimer

DTLab makes no representations and offers no warranty to the user with respect to the accuracy or completeness of the information provided on the dtlab-labcn.org website. Similarly, DTLab is not responsible for any errors or omissions in the information contained on the website, or for any decisions made by the user based on the content of the dtlab-labcn.org website.

DTLab cannot guarantee that access to its website will not be hindered by interruptions, delays, breakdowns, errors or losses during the transmission of information, or that any virus or other virulent or destructive properties will not be transmitted. Therefore, DTLab shall not incur any liability under these Terms & Conditions should these circumstances arise.


Governing law

These Terms & Conditions are governed by and are to be construed in accordance with the laws applicable in the Province of Quebec and the Canadian federal laws applicable in that province, without giving effect to any conflict of laws.


Severability

If any provision hereof is found to be invalid, illegal or unenforceable, the remainder will be enforced as fully as possible. In addition, the invalid, illegal or unenforceable provision will be deemed modified to the extent required to permit its enforcement in a manner most closely representing the intention of the Parties as expressed herein.


Review and modification of website content

DTLab may, at any time, at its sole discretion and without notice, update, review and otherwise modify the content of its website.


Modification of the Terms & Conditions

These Terms & Conditions may be revised or modified from time to time and without notice, the most current and official version being available on the DTLab website. If the Privacy Policy portion is modified, we will inform you by means of a notice on our website. In all cases, you are responsible for reviewing the changes. By continuing your use of the website following any such revisions or modifications, you agree to be bound by the new provisions of the Terms & Conditions.

These Terms & Conditions, including this Privacy Policy, are published and updated on the authority of the President & CEO. They are considered as a directive for the purposes of the approval process.
